PRODUCT WARRANTY

All JADISE products are Made in Italy. Purchases from the official website come with a 2-year warranty.

Legal Guarantee of Conformity

All products sold on the website www.jadise.it are covered by the Legal Guarantee of Conformity pursuant to Articles 128 to 135 of Legislative Decree no. 206/2005 (“Consumer Code”; “Legal Guarantee”).

If a Product sold by JADISE – MODALAB Srl has any manufacturing defects or, in any case, a presumed non-conformity, the Customer is required to contact the Online Assistance via customercare@jadise.it.

The legal guarantees established by Articles 129, 130 and 132 of the Consumer Code, as defined below, apply to the sale of the Products. Based on these Articles, the Customer has the right to request – at no cost – the repair (or replacement) of the Product within the limits established by law or, where one of the remedies set out above is not available (pursuant to Article 130, paragraph 7 of the Consumer Code), to receive a reduction in the price of the Products or to terminate the contract.

TO WHOM IT APPLIES

The Legal Warranty is for consumers only. Therefore, it applies only to users who have made a purchase on the website for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out.

WHEN IT APPLIES

The seller (and thus, with regard to purchases made on the website www.jadise.it) is liable to the consumer for any lack of conformity existing at the time of delivery of the product and occurring within two years from such delivery. Any lack of conformity must be reported to the seller, at the risk of invalidity of the Warranty, within two months from the date on which such was discovered.

Unless there is evidence to the contrary, it is assumed that the lack of conformity to have arisen within the first 6 months from the delivery date of the product already existed as of such date, unless such a hypothesis is incompatible with the nature of the product or the lack of compliance. As of the seventh month following delivery of the product, it will instead fall to the consumer to prove that the lack of conformity already existed at the time of delivery of the same.

In order to avail of the Legal Guarantee, the user must thus first provide proof of the date of purchase and delivery of the goods. It is therefore advisable for the user – for the purposes of such proof – to keep the purchase invoice that JADISE – MODALAB Srl issues, as well as the transport document or any other documentation able to certify the date of purchase (such as credit card or bank statement) and the delivery date.

WHAT IS A DEFECT IN CONFORMITY?

A lack of conformity exists when the purchased good:

  • proves unsuitable for the use for which similar goods are normally employed;
  • does not align with the description made by the seller and does not possess the qualities of the goods that the seller has presented to the consumer as a sample or model;
  • does not have the usual qualities and performances of a good of the same type, as the consumer can reasonably expect, also taking into account the statements made in the advertising or on the labelling;
  • is not fit for the particular use desired by the consumer and such has been brought to the attention of the seller at the time of entering into the contract, which the seller has accepted.

Any faults or malfunctions caused by accidental events or under the user’s responsibility or due to a utilisation of the product that does not comply with its intended use and/or as set out in the technical documentation attached to the product are thus excluded from the scope of the Legal Guarantee.
